For more than a generation, historical interpretations of emancipation in the United States have acknowledged that the slaves played a central role in driving that process forward. This is a critically important advance, and one worth defending. But it is also a perspective whose influence seems increasingly precarious. This article explores the complex relationship between the slaves’ ‘revolution from below’ and the bourgeois revolution directed from above, in part through an appraisal of W.E.B. Du Bois’s argument about the ‘slaves’ (...) general strike’ and the wider revolutionary upheaval encompassing civil war and reconstruction. Grounded in a close familiarity with sources and interpretive trends, the article offers a detailed reading of shifting perspectives in current historiography, a comprehensive review of left engagement with Du Bois’s work, and an extended ‘critical and sympathetic’ appraisal of his major work from within the framework of the Marxist tradition. This paper challenges Tony Lawson's account of the relationship between mainstream economics and ideology along two key axes. First off, we argue that Newtonian physics has been the primary version of pro-science ideology within mainstream economics, rather than mathematics per se. Secondly, we argue that the particular uses of mathematics within mainstream economics have always been ideological in the pro-capitalist sense of the term. In order to defend these claims we develop a line of argument that Lawson has thus far (...) strategically avoided. Namely, we view mainstream economic theory as an integrated theoretical paradigm with intrinsic links to the capitalist economy. Viewed in this way, it becomes clear that Lawson's (trans) historical account of ideology is too general to capture the complexity of the relationship between natural science, mathematics and mainstream methods. Having briefly outlined Lawson's central argument, we highlight the non-mathematical methods underpinning Classical Political Economy. Thereafter, we assess the nature of the mathematics associated with the Marginal Revolution of the 1870s and the Formalist Revolution of the 1950s. (shrink)

Marx did not have a normative theory, that is, a theory that purported to justify, discursively and systematically, his normative opinions, to show them to be rationally obligatory or objectively valid. In this regard, Marx was obviously not alone: almost everyone, including those who lead what are widely regarded as exemplary ‘moral’ lives, decide and act on the basis of normative intuitions and inclinations that fall far short of a theory. Yet self-proclaimed Marxists like G. A. Cohen and Jurgen Habermas (...) have reintroduced a kind of normative theory into the Marxian tradition that Marx himself would have ridiculed. This essay defends Marx’s position and tries to explain the collapse of Western Marxism into bourgeois practical philosophy, i.e., philosophizing about what ought to be done that is unthreatening to capitalist relations of production. Since a bio-cultural model of the human can only be richer than a solely cultural model, and since it implies neither genetic determinism nor limitation to the status quo, I want to argue for a bio-cultural or evolutionary approach to literature, first in very general terms, and then through a few aspects of a single familiar example, Hamlet.2 Such an approach, I suggest, can offer both a more comprehensive theory of literature and a closer investigation of literary texts. I Traditional views of literature tended to see it as reflecting nature, especially human nature, all the way from Plato's discomfort with, or Aristotle's admiration for, mimesis to Shakespeare's or Stendhal's images of art as holding the mirror up to nature. Common-sense traditional views of art and literature have easily shaded into transcendental views, widespread because religious beliefs have been so pervasive and because both artists and their patrons in state or church benefit by nurturing a sense of awe at art's putatively divine origins and power.In the twentieth century, first in sociology, anthropology, and even [End Page 1] psychology, then by the 1960s in the combination of these with Saussurean linguistics that produced structuralism and its aftershocks, and therefore impacted on literature, there has been a rejection of human nature as a given and a stress on human nature as the product only of culture and convention. "Theory," or what the Norton Anthology of Theory and Criticism more pointedly calls cultural critique, rightly critiques traditional common-sense and transcendental views of art, pointing out that the nature, human nature, or supernature that art or literature was supposed to reflect was merely what was assumed of these things from within a local cultural perspective.3 Roland Barthes, for example, criticized "the mystification which transforms petit-bourgeois culture into a universal nature."4 Modern Theory also rejects the individual as another bourgeois or capitalist or Western notion, as when Fredric Jameson echoed Barthes's Death of the Author by announcing the Death of the Subject.5 Criticism since the 1960s "has denied, on theoretical grounds, the relevance of the single historically definable author."6However, as many have lately realized, there are problematic ethical consequences of both the denial of human nature and the denial of the individual. After such denials, on what basis do we then claim equal rights for all humans, and on what basis do we assign responsibility for particular actions?7 If there is no "single historically definable author," does that mean that someone penning a racist screed cannot be held accountable?A critique of unquestioned Western assumptions about human nature was needed, but the post-1960s critique was shortsighted: it has not looked nearly far enough. While structuralism and its more or less rebellious offspring were continuing the lineage of early twentieth-century social sciences, the natural sciences were moving in the opposite direction, towards the first comprehensive scientific attempt to understand human nature in the context of evolution and human, animal, and artificial cognition and behavior.In the humanities there has of late been widespread skepticism about science. We discuss two interpretations of two-dimensional semantics (2DMS) due to D. Chalmers and R. Stalnaker. The main problem with both interpretations of the formal framework is the relinquishng of rigidity for terms. They are in a sense unfaithful to an agent's beliefs. We present alternative principles to capture what we take to be agents's beliefs, namely: the principles of hyper-rigidity and backward reference to actuality. We propose then to go back to a one-dimensional semantics which affords a satisfactory model of (...) beliefs reports. Our proposal, like 2DMS, addresses typical problems of representation for beliefs and epistemological difficulties related to modal knowledge. (shrink)

Central to Kierkegaard’s account of religious existence is his critique of speculative reason. This critique begins with the distinction between subjective and objective reflection. Its most radical aspects appear in Kierkegaard’s discussions of the paradox. In spite of Kierkegaard’s frequent comments on this notion, it is not readily understood. I want to argue against a common reading of this notion and propose an alternative reading. This alternative reading allows for a conceptually quite plausible account of the manner in which the (...) paradox presents reason with a boundary, in virtue of its relation to objective reflection and to subjective reflection as well. Because of this boundary, reason points beyond its own achievements to a domain of contemplation and appropriation. This is a domain that reason itself identifies in connection with the paradox. Foss's critique of van Fraassen's constructive empiricism is shown to be completely wide of the mark (Foss 1984, van Fraassen 1980). Foss misunderstands van Fraassen's use of the terms 'observable', 'phenomena', 'empirical adequacy', and 'epistemic community'. He misconstrues constructive empiricism as making knowledge, and perhaps existence, dependent on the observer. On the basis of this error, he attempts to reduce constructive empiricism to skepticism. None of his criticisms are to the point.

Zalta's Modal Axiom of Encoding is weakened and the notion of 'quasi-encoding' is spelt out.

A coherent practice of mens rea (‘guilty mind’) ascription in criminal law presupposes a concept of mens rea which is insensitive to the moral valence of an action’s outcome. For instance, an assessment of whether an agent harmed another person intentionally should be unaffected by the severity of harm done. Ascriptions of intentionality made by laypeople, however, are subject to a strong outcome bias. As demonstrated by the Knobe effect, a knowingly incurred negative side effect is standardly judged intentional, whereas (...) a positive side effect is not. We report the first empirical investigation into intentionality ascriptions made by professional judges, which finds (i) that professionals are sensitive to the moral valence of outcome type, and (ii) that the worse the outcome, the higher the propensity to ascribe intentionality. The data shows the intentionality ascriptions of professional judges to be inconsistent with the concept of mens rea supposedly at the foundation of criminal law. (shrink)

Cet oubli appauvrit sans doute leur foi, mais peut s’expliquer : la sécularisation a produit un effacement de la notion de création, qui a perdu son évidence culturelle, la question de l’origine est laissée à la science, le croyant trouve Dieu dans la proximité du présent et ne le cherche plus dans l’espace originaire, et des attitudes croyantes, autrefois liées à cette notion, s’expriment aujourd’hui autrement sans altération de la foi. It seems that the second tries to assume the first as a sapiential way with universal import. The faith of numerous Christians, however, does not seem to even imply this weak belief. Without doubt, this omission impoverishes their faith but can be explained : secularization wiped out the idea of creation when it lost its cultural importance. The question of origins is left to science, ; the believer finds God in the proximity of the present and no longer looks for the original space. It is also true that believing attitudes, which were tied to this notion in the past, express themselves today in another way, without changing the faith. Theology would be better off if it analysed the connection of creation to culture and make explicit the role that the Holy Spirit plays in the mystical perspective of annihilation or of “de-creation”. Ce qui a changé dans les dernières (...) décennies, c'est peut-être la manière d'appréhender ces interrogations fondamentales : on recueillait autrefois les réponses en se référant à sa religion d'appartenance ou en puisant dans un ensemble de discours et de pratiques proprement ésotériques ; aujourd'hui, la recherche de principes directeurs qui soient à même de donner un sens à l'existence n'échappe pas au mouvement général de sécularisation et de globalisation qui a radicalement transformé nos cultures. Anticipant cette tendance, Ostad Elahi s'était interrogé, il y a plus de cinquante ans, sur les conditions d'une sagesse contemporaine partagée, capable d'intégrer la dimension spirituelle, et fondée sur les principes fondamentaux communs aux différentes religions. Sous le titre Quelle sagesse pour notre temps?, cet ouvrage entend ouvrir une réflexion sur les modalités que peut prendre la recherche d'une telle sagesse adaptée à notre époque, à la fois conforme à l'idéal d'autonomie de l'individu moderne et ouverte à ses aspirations les plus profondes. Quels en seraient les principes? Parviendra-t-on à les dégager en s'accordant sur des valeurs éthiques et spirituelles universelles? Et si oui, comment est-il possible de les mettre en oeuvre? Une recherche de ce genre relève-t-elle d'une démarche strictement individuelle, ou peut-elle être également conduite de manière collective, à un niveau académique et plus généralement institutionnel? This paper adjudicates the debate between Russell and Meinong on the tenability of Meinong's theory of objects. The conclusion is that while Russell did not adequately reply to ueinong's defence of the theory, The defence is nonetheless, unsuccessful. The contemporary interest in Meinong's theory, the controversial features of the theory, Russell's objections, and Meinong's replies are discussed.

Une analyse de la prière rogatoire (de demande) dirigée vers un état de choses passé est proposée. Je sais qu'un Boeing s'est abîmé en mer, je prie pour qu'un être cher, peut-être déjà mort, ait survécu. On examine les conditions sous lesquelles une telle demande est i) rationnelle et ii) peut être efficace. Deux réponses traditionnelles à ces questions sont particulièrement examinées: la solution moliniste d'une part et les discussions talmudiques sur la prière vaine d'autre part.

My aim in this memorial paper is to recall two essential Ricoeurean themes that underlie his entire philosophical orientation and that respond well to specific challenges today from post-modern deconstruction. At question is whether Ricoeur's account of sign in language and the living present in time can adequately respond to and meet the recent challenge from postmodern deconstruction, which radically challenges the very root of his phenomenological and hermeneutic orientation: the priority of the semantic in language and the priority of (...) the living present. Although Ricoeur and Derrida will be seen to address the same problems of decentering consciousness, their accounts, although agreeing on important issues, quickly become mutually exclusive and deconstruction becomes a challenge to Ricoeurean hermeneutics. I will turn first to the postmodern deconstruction of Jacques Derrida before turning to Ricoeur's response with a more viable view of language, sense, and lived time. (shrink)

Condition essentielle de la responsabilité civile, la notion de causalité reste aujourd’hui difficile à saisir et sujette à nombreuses discussions. Les contributions présentées dans cet ouvrage abordent la question à nouveaux frais, en adoptant un point de vue résolument interdisciplinaire mêlant philosophie, droit et économie. Sont envisagées successivement des difficultés que le contentieux de la causalité met régulièrement en évidence. Ainsi, la difficile articulation entre causalité juridique et causalité scientifique conduit à s’interroger sur le rôle de la science : doit-elle (...) guider le droit ou faut-il considérer que la causalité en droit n’est qu’un “construit” juridique dégagé de toute perspective scientifique ? Sont également évoquées les diverses tentatives de formalisation analytique de la causalité comme l’analyse contrefactuelle, le critère NESS et les définitions probabilistes de la causalité, ainsi que leur capacité à répondre aux questions redoutables suscitées par la présence de co-auteurs multiples ou d’hypothèses de “surdétermination causale”. Ces réflexions fondamentales ouvrent alors sur les autres aspects clefs de la causalité en droit et en économie comme la preuve et le rôle du raisonnement probabiliste, ou les modalités de la contribution à la dette de réparation en présence d’une pluralité de co-auteurs. Est alors mis en évidence l’apport des sciences économiques, qui permet de classer les différentes techniques d’attribution de la responsabilité et de discuter des propriétés économiques des règles de répartition de la charge de la dette de réparation. Cet ouvrage s’adresse aux chercheurs et aux praticiens confrontés aux questions délicates posées par la causalité dans le droit de la responsabilité civile. (shrink)

We propose an axiomatization of aversion to incomplete preferences. Some prevailing models of incomplete preferences rely on the hypothesis that incompleteness is temporary and that by keeping their opportunity set open individuals reveal a preference for flexibility. We consider that the maintenance of incomplete preference is also aversive. Our model allows us to show how incompleteness induces an aversive attitude in two different ways: intrinsic and instrumental. Intrinsic aversion holds when one instance of incomplete preference in the set suffices to (...) decrease its utility. Instrumental aversion holds only insofar dominating options are affected by incompleteness. Given two partially overlapping sets of axioms on the binary relation over sets we formalize their consistency with the two types of aversion to incompleteness. Finally, we relate our model to the classical Sen’s distinction between tentative and assertive incompleteness. The spelling out of this distinction in the terms of our approach uncovers to what extent aversion to incompleteness may be compatible with a preference for flexibility. (shrink)
